Federal Regulations for Paid Truck Parking

Purpose

Parking lot regulations are established to ensure the safe and organized use of parking areas, facilitate efficient traffic flow, mitigate congestion, and provide adequate accessibility for individuals with disabilities. These regulations typically govern aspects such as parking space dimensions, directional layout, designated parking zones, and vehicle access points, while also addressing the needs of pedestrians and environmental considerations. Additionally, many municipalities impose requirements to regulate the number of parking spaces. 


This proposal addresses the abusive implementation and proliferation of paid parking by businesses not licensed to provide parking services, emphasizing the need for regulations to ensure such facilities offer essential safety, liability, and environmental amenities. 

We propose that you consider requiring businesses that charge for parking services for vehicles bearing interstate U.S. DOT numbers be required to comply with the following requirements.

  • Emergency Response Plans:
    • Develop and maintain comprehensive emergency response plans.
    • Include a Fire Response Plan for prevention, evacuation, and coordination with local fire departments.
    • Include a Hazmat Response Plan for handling hazardous material spills and incidents.
    • Conduct annual training and drills for facility staff on emergency protocols.
  • Minimum Security Protocols:
    • Install adequate lighting throughout the premises.
    • Deploy trained security personnel during peak hours.
    • Implement mandatory video surveillance systems covering entry/exit points and parking areas, with footage retained for a minimum of 30 days.
    • Use access control systems to prevent unauthorized entry and ensure safety.
  • Public Nuisance Protocols:
    • Enforce noise control measures, including restrictions on idling engines.
    • Manage traffic flow to avoid congestion on public roads.
    • Coordinate with local law enforcement to address community issues promptly.
  • Restroom and Public Sanitation Facilities:
    • Provide clean and accessible restrooms with regular maintenance schedules.
      • That no parking space be located no further than 150 feet from any plumbing equipped restroom facility.
    • Install adequate trash disposal facilities.
    • Ensure hygiene provisions, such as handwashing stations, meet public health standards.
  • Liability for Theft and Damage:
    • Accept un-waivable liability for theft or damage to vehicles or cargo.
    • Maintain mandatory insurance coverage to compensate drivers and carriers for losses.
    • Provide clear processes for filing and resolving claims.
  • Video Recording Requirements:
    • Install comprehensive video surveillance systems to cover all critical areas.
    • Retain recordings for at least 30 days for investigation purposes.
    • Provide recordings to law enforcement or affected parties upon request.

Enforcement and Accountability

  • Audits and Inspections: Federal and local authorities will conduct regular inspections to ensure compliance.
    • Extend enforcability to state and local authorities.
  • Penalties:
    • Fines based on the severity of violations.
    • Suspension or revocation of operating permits for repeated violations.
  • Public Reporting: A publicly accessible database will track violations and enforcement actions against facilities to ensure transparency.
