Claim Deductions

BROKER STATEMENT:
Broker shall be entitled to deduct any damages or claims against all of Carrier's outstanding receivables.

 

OODCCO STATEMENT:
According to the law, carriers are entitled to be paid for their services, unless they did something wrong. This is known as the "carrier gets paid" rule, which has been cited in multiple court cases.

Here are some things to know about carriers and payment:

Who pays
On a brokered load the broker is primarily responsible for paying the carrier, and the shipper & consigner is secondarily responsible.

Liability
If a carrier isn't paid by the broker, the shipper and consignee may be required to pay the freight charges twice.

Brokers will often include language requiring carriers to wave this by stating "Unless written waiver is obtained from Broker, Carrier shall look only to Broker, and not to the involved Shipper, Consignee, or customer of Broker, for payment of Carrier's freight charges.".

OODCCO does not have such  a requirement
